ABOUT BANNER WITCOFF

1. Give us your organization’s quick origin story!

Since its inception, Banner Witcoff has led the way in IP law across all technologies and industries, particularly in the field of computer technology. Founder Sheldon Witcoff was the first examiner of patent applications for electronic computers for the U.S. Patent Office in 1949. In 1973, we participated in a nine-month trial, one of the longest in history at the time, to prove that John Atanasoff was the first inventor of the electric computer, the ENIAC. In the late 1960’s, we also pioneered the use of computers in courtroom pre-trial discovery and document management.

Now, our attorneys continue to excel in all aspects of IP. Banner Witcoff has been recognized as one of the best performing and most active law firms in inter partes review (IPR). And, in 2019, Banner Witcoff received industry recognition and an “Impact Case of the Year” award for our work representing Converse in its trademark battle against entities selling knock-off versions of the company’s iconic Chuck Taylor All Star sneaker. Banner Witcoff is also a leader in procuring design patent portfolios for clients, and for 20 consecutive years, we have obtained more U.S. design patents than any other law firm in the United States. 2. What problem are you currently solving in the KC tech industry? 

IP is a strategic asset for companies to protect their innovations, inventions, and unique creations from unauthorized use or imitation. Tech companies often invest heavily in R&D to create new technologies, software, hardware, and processes. IP protection (e.g., patents, copyrights, and trade secrets) ensures that these innovations are safeguarded against unauthorized use, imitation, or theft, by providing companies with the legal means to take action against infringers and secure injunctions and monetary damages. IP rights are essential for companies to build brand identity, secure customer loyalty, and command higher market prices

3. What can we expect to see from your organization in the next year?

Banner Witcoff is committed to enhancing the knowledge and capabilities of our clients and interested individuals by offering comprehensive programs. Throughout 2025, Banner Witcoff will host numerous Corporate IP Roundtables in the Chicago and DC metropolitan areas. Our Corporate IP Roundtable programs are in-person programs intended for in-house intellectual property attorneys providing a unique opportunity for in-depth discussions on key legal issues, emerging trends, and strategic considerations. Banner Witcoff will also host various WITCON Delivered programs. These are hybrid programs hosted throughout the country where Banner Witcoff attorneys explore IP strategies that you can leverage to protect your company’s intellectual property.

1. If your office was The Office, what character would you be?

I actually haven’t watched the Office, but based on what I’ve seen online I’d be the BJ Novak taking notes meme. I want to keep track of what our firm is doing at any given time as well as stay up on current technology and legal tends. But admittedly I have no idea the context of his note-taking within the show so hopefully that’s not way off base!

2. What’s an app you can’t live without?

Currently it’s Balatro, a game that is consuming too much of my down time. But usually it’s Twitter (it will always be Twitter to me) for both news and entertainment or Kindle for winding down at night.

3. What’s your favorite hidden gem in Kansas City?

Hi Hat Coffee, which powers way too many of my mornings, and the Hey Hey Club at Rieger Distillery, which is where my wife and I had our rehearsal dinner and enjoy finding excuses to go back to.

4. What technology tip are you always giving your clients?

Companies often think of obtaining IP rights after developing a new technology, product, or brand. But by taking a proactive approach and considering IP implications throughout the design process, companies can make strategic decisions to avoid potential pitfalls and maximize the value of their IP rights in the future.
